PERFORMANCE SERVICES, INC. PRIVACY POLICY

This Privacy Policy (“Policy”) explains how Performance Services, Inc. (“Performance Services,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit www.performanceservices.com, and www.performanceservicesdesign.com (the “Sites”), submit an inquiry or request through the Site, apply for a position with us, subscribe to our communications, or otherwise interact with us in connection with the Site.

The Site is an informational and business-development resource. It is not an online store, and we do not sell products or process consumer payments through the Site. The professional services we provide to clients are governed by separate written agreements, not by this Policy.

This Policy applies only to information collected through the Site and our related business-development, marketing, and recruiting activities. It does not apply to information we receive or generate in the course of performing contracted project work, which is addressed in the applicable project agreements, or to third-party websites we do not control. Please read this Policy carefully. If you have questions, contact us using the information in the “How to Contact Us” section below.

PERSONAL INFORMATION WE COLLECT

We collect the categories of personal information described below. “Personal information” means information that identifies, relates to, or is reasonably linkable to an identified or identifiable individual. It does not include de-identified, aggregated, or publicly available information.

We do not intentionally collect Social Security numbers, government identification numbers, financial account numbers, precise geolocation, or other sensitive personal information through the Site. We also do not knowingly collect personal information from children, as described in the “Children’s Privacy” section below.

HOW WE USE PERSONAL INFORMATION

We use the personal information we collect for the following business purposes:

To respond to your inquiries, requests, and submissions, and to communicate with you about potential or existing projects and engagements;
To evaluate and respond to employment applications and to administer our recruiting process;
To send newsletters, resources, event invitations, and other marketing communications you have requested or that relate to our services, subject to your right to opt out;
To operate, maintain, secure, and improve the Site, and to understand how visitors use it;
To measure the effectiveness of, and to deliver, our marketing and advertising;
To maintain business records and manage our relationships with clients, prospective clients, vendors, and partners;
To detect, prevent, and respond to fraud, security incidents, and misuse of the Site; and
To comply with applicable law and legal process, to enforce our agreements and these online terms, and to establish, exercise, or defend legal claims.

We may also use de-identified or aggregated information, which is not subject to this Policy, for any lawful purpose.

COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES

We and our service providers use cookies, pixels, tags, and similar technologies to operate the Site, remember your preferences, analyze traffic and usage, and support our marketing. These technologies may collect internet and device activity data as described above.

The Site uses analytics and tag-management tools (including Google Analytics, Google Tag Manager, Clicky, Leadfeeder, HubSpot, and Semrush), is served through a content-delivery and security provider (Cloudflare), and uses advertising and audience tools (including Microsoft (Bing) Ads, Google Ads, Meta, LinkedIn, Microsoft Clarity, and StackAdapt).

You can usually set your browser to refuse or delete cookies, and you can opt out of certain analytics and advertising as described in the next section. Some features of the Site may not function properly if you disable cookies.

ONLINE ADVERTISING AND YOUR CHOICES

We use third-party tools to deliver and measure advertising and to reach relevant audiences across other websites and platforms. These tools may use cookies and identifiers to associate your activity on the Site with advertising shown to you elsewhere.

You can exercise choices about interest-based advertising as follows:

Industry opt-out pages: the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org);
Platform settings: the advertising and privacy settings offered by Google and Microsoft;
Browser controls and Global Privacy Control (GPC): we honor browser-based opt-out preference signals such as GPC where required by law. The Site does not respond to legacy “Do Not Track” browser signals.
“Your Privacy Choices” link: where available, you can manage your advertising and tracking preferences and opt out of targeted advertising through the “Your Privacy Choices”

Because these choices rely on cookies and device identifiers, they are specific to the browser and device on which you set them and may need to be renewed if you clear cookies or use a different device.

SMS/TEXT MESSAGE COMMUNICATIONS

If you opt in to receive SMS (text) messages from us, the following terms apply.

Consent. Phone numbers and consent obtained as part of the SMS opt-in process will be used only to send you the messages you have requested and will not be shared with any other third parties for marketing purposes, other than any service provider that processes the opt-in or delivers messages on our behalf.

Types of messages. If you have consented to receive text messages from us, you may receive messages related to your inquiries and requests, potential or existing projects and engagements, scheduling, and recruiting communications.

Message frequency. Message frequency will vary depending on your inquiry and our communications with you.

Fees. Message and data rates may apply. Many carriers charge a fee for each message sent or received, which can vary depending on the carrier’s pricing structure and whether the message is sent domestically or internationally.

Opt-in method. You may opt in to SMS messaging from us through forms on the Site or by otherwise providing us your mobile number and consent.

Opt-out. You may opt out of SMS messaging at any time by replying STOP to any message you receive from us. Once you opt out, you will receive no further SMS messages; you may opt back in at any time by replying START. For assistance, reply HELP or contact us using the information in the “How to Contact Us” section.

HOW WE DISCLOSE PERSONAL INFORMATION

We disclose personal information in the following circumstances:

Service providers. To vendors that perform services on our behalf, such as website hosting, security, analytics, email and marketing delivery, recruiting and applicant-tracking, and IT support. These providers are permitted to use personal information only to provide services to us.
Advertising and analytics partners. To the analytics and advertising providers described above, subject to the choices in the “Online Advertising and Your Choices” section.
Professional advisors. To our attorneys, accountants, insurers, and similar advisors, where appropriate.
Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of assets, or due diligence relating to any of the foregoing.
Legal and safety. To comply with applicable law, regulation, legal process, or governmental request; to enforce our agreements and terms; and to protect the rights, property, or safety of Performance Services, our clients, or others.

We do not disclose personal information to third parties for their own independent marketing purposes.

“SALE” AND “SHARING” OF PERSONAL INFORMATION

Performance Services does not sell your personal information for money. However, our use of certain analytics and advertising tools (see the “Online Advertising and Your Choices” section) may be considered a “sale” or “sharing” of personal information for “targeted advertising” under some state privacy laws because those tools may receive identifiers tied to your device or browser. You can exercise choices about this activity using the opt-out methods in the “Online Advertising and Your Choices” section and the rights described in the “Notice to California Residents (CCPA/CPRA)” and “Notice to Residents of Other U.S. States” sections. You may also opt out of this activity at any time through the “Your Privacy Choices” link.

THIRD-PARTY LINKS AND SOCIAL MEDIA

The Site contains links to third-party websites and includes our profiles on platforms such as LinkedIn, Facebook, Instagram, YouTube, and Vimeo. We are not responsible for the privacy practices or content of those third parties. Information you share on or through a third-party platform is governed by that platform’s own privacy policy and terms, not this Policy. We encourage you to review the privacy notices of any third-party site or platform you visit.

DATA RETENTION

We retain personal information for as long as needed to fulfill the purposes described in this Policy, including to respond to your inquiries, pursue and document business relationships, administer recruiting, maintain business and tax records, and comply with our legal obligations. When personal information is no longer needed, we take reasonable steps to delete, de-identify, or securely store it. We retain data for 10 years.

DATA SECURITY

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure, appropriate to the nature of the information. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

CHILDREN’S PRIVACY

The Site is intended for adults and is directed to businesses, public bodies, and institutions. It is not directed to children, and we do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (“COPPA”) or from children under the age established by applicable state law. If we learn that we have collected personal information from a child without appropriate consent, we will delete it. If you believe a child may have provided us with personal information, please contact us using the information below.

JOB APPLICANTS AND CAREERS

If you apply for a position with Performance Services, we use the information you provide to evaluate your application, communicate with you about the opportunity, conduct the recruiting process, and maintain records as required by law. We may retain applicant information to consider you for future opportunities unless you ask us not to. Applications are processed through BambooHR, HubSpot, and Gravity Forms which may be subject to the provider’s notice.

NOTICE TO CALIFORNIA RESIDENTS (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), may apply to our processing of your personal information. Subject to the CCPA’s conditions and exceptions, California residents have the right to: (i) know and access the categories and specific pieces of personal information we have collected about them, the categories of sources, the business or commercial purposes for collecting, “selling,” or “sharing” it, and the categories of third parties to whom we disclose it; (ii) delete personal information we collected from them; (iii) correct inaccurate personal information; (iv) opt out of the “sale” or “sharing” of personal information; (v) limit the use and disclosure of sensitive personal information (which, as described above, we do not intentionally collect through the Site); and (vi) not be discriminated against for exercising these rights.

As stated in the “How We Disclose Personal Information” section, we do not disclose personal information to third parties for their own independent marketing purposes. California residents with an established business relationship with us may nonetheless request a notice under California’s “Shine the Light” law (Civil Code § 1798.83) regarding any such disclosures during the preceding year by contacting us using the information in the “How to Contact Us” section.

NOTICE TO RESIDENTS OF OTHER U.S. STATES

A number of other U.S. states — including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia (collectively, the “Regulated States”) — have adopted comprehensive consumer data-protection laws that generally define a “consumer” as a resident of the state acting only in an individual or household context (and not in a commercial or employment context). If you are a consumer in a Regulated State and the applicable law applies to our processing of your personal information, you may have some or all of the following rights, subject to the law’s conditions and exceptions:

To confirm whether we process your personal information and to access that information;
To correct inaccuracies in your personal information;
To request deletion of your personal information;
To obtain a portable copy of personal information you provided to us; and
To opt out of targeted advertising, of any “sale” or “sharing” of personal information, and of profiling in furtherance of decisions that produce legal or similarly significant effects, as described in the “Online Advertising and Your Choices” and “Sale” and “Sharing” of Personal Information sections.

We will not discriminate against you for exercising any of these rights. Some Regulated States require opt-in consent to process sensitive personal information; we do not intentionally collect sensitive personal information through the Site, and if that changes we will obtain any consent required by applicable law.

HOW TO EXERCISE YOUR RIGHTS

To exercise any of the rights described above, submit a request using the information in the “How to Contact Us” section. To opt out of targeted advertising or the “sale” or “sharing” of your personal information, you may also use the “Your Privacy Choices”. Your request must provide enough information for us to reasonably verify that you are the person about whom we collected personal information (or that person’s authorized representative) and must describe your request with enough detail for us to understand and respond to it.

Verification. To protect your privacy and maintain security, we will take reasonable steps to verify your identity before granting access to, deleting, or correcting your personal information, and we may ask you to provide additional information for that purpose. You may use an authorized agent where applicable law permits; we may deny a request if the agent does not submit proof of valid authorization.

Our response time. We will respond to a verifiable request without undue delay and within forty-five days of receipt. The response period may be extended once by an additional forty-five days when reasonably necessary; if so, we will inform you of the extension and the reason within the initial 45-day period.

Right to appeal. If we decline to act on your request, we will inform you of our decision and the reasons. You may appeal by contacting us using the information in the “How to Contact Us” section. Within the time required by applicable law (usually 45 or 60 days, depending on the state), we will respond in writing with an explanation of the reasons for our decision and any action taken or not taken. If your appeal is denied, you may contact the Attorney General or other supervisory authority in your state, whom we will help you identify.

INFORMATION PROCESSED IN THE UNITED STATES

Performance Services is based in the United States, and we process and store personal information in the United States. If you access the Site from outside the United States, you understand that your information will be processed in the United States, where data-protection laws may differ from those in your location.

CHANGES TO THIS POLICY

We may update this Policy from time to time. When we make changes, we will revise the “Last Updated” date above. If we make material changes, we will provide additional notice as required by law, such as by posting a prominent notice on the Site. We encourage you to review this Policy periodically.
